General Terms and Conditions of Sales

Le Vélo voyageur is a simplified joint-stock company, located at 6 Rue Fontenille, 34000 Montpellier, registered with the Montpellier Trade and Companies Register under number 529 884 116. Hereinafter referred to as “Le Vélo Voyageur.”
Le Vélo voyageur offers itinerant cycling holidays in France and Europe.
The Client refers to the natural person who has subscribed to the services offered by Le Vélo voyageur.
Le Vélo voyageur and the Client are individually referred to as a “Party” and collectively as the “Parties.”

Article 1. Purpose of the Contract

This contract aims to define:
• The terms of subscription to the services offered by Le Vélo voyageur,
• The rights and obligations of the Parties under the contract,
• The financial and legal conditions for subscribing to and using the services.

Article 2. Orders

Registration for one of the trips offered by Le Vélo voyageur must be made via our website www.levelovoyageur.com (referred to as “our website”). Prior communication may take place by phone or email with an advisor.
After selecting the travel services, the Client completes an order form via the website, sent by email by an advisor, or by accepting the pre-filled form by return email.
The order is considered final once the form is completed.
A confirmation email will be sent to the Client.
A travel guide will be sent to the Client fifteen (15) days before departure.

Article 3. Payment for Services

3.1. Price
Trip prices are detailed on the description sheets available on the website.
Only services explicitly mentioned in the trip descriptions are included in the price.
Unless otherwise specified, the base package excludes transportation to the departure location, ticketing fees, tourist taxes, vaccination fees, visas, unlisted meals, beverages, personal expenses, optional activities, and any services not expressly indicated.
Waiving an included service does not entitle the Client to any refund or credit.

3.2. Payment Terms
For bookings made more than 30 (THIRTY) days before departure, a deposit of 30% of the total price is required at the time of booking.
For bookings made less than 30 (THIRTY) days before departure, full payment, including any insurance fees, is required.
Accepted payment methods:
• Credit card
• Bank transfer,
• Check,
• Holiday vouchers (capped at 50% of the total price).

3.3. Payment Default
If the balance is not paid within 15 (FIFTEEN) days, Le Vélo voyageur reserves the right to suspend the service, with all costs remaining the Client’s responsibility.
Without full payment, Le Vélo voyageur cannot guarantee availability of the trip.

Article 4. Price Revisions

Price increases are only possible if they result directly from:
• Changes in passenger transportation costs (fuel or energy prices),
• Changes in taxes or fees imposed by third parties (tourist taxes, airport/port fees),
• Exchange rate fluctuations relevant to the contract.
If the price increase exceeds 8% of the initial trip price, the Client will be informed on a durable medium at least 20 (TWENTY) days before departure. The Client then has 7 (SEVEN) days to accept the change or cancel the contract free of charge.

Article 5. Gift Vouchers and Credit Notes

1. Gift Vouchers
Gift vouchers can be purchased via the “Offer this trip” link on Le Vélo voyageur’s website.
Payable in full upon purchase, the voucher can either be for a specific trip or a freely chosen amount usable on any trip. It does not specify a departure date and does not limit the buyer to a particular package.
The voucher is represented by a discount code with a monetary value.
It can be used for any trip or service offered by Le Vélo voyageur, subject to availability and current pricing.
The discount code is valid for one year from the date of issue and is:
• Strictly personal and reserved for the beneficiary,
• Non-transferable,
• Indivisible and cannot be used partially,
• Not extendable beyond its validity period.
It states the beneficiary’s name, buyer’s name, code reference, monetary value, and expiry date.
It is sent by email or post.
The beneficiary must enter the code when booking on the website. If the booking exceeds the voucher’s value, the difference is payable. No refund is given if the voucher exceeds the booking value.
The voucher must be used before its expiry. Once the reservation is validated, Article 2 terms apply. Booking remains subject to availability.
2. Validity of Credit Notes
Any credit note issued by Le Vélo voyageur, regardless of reason, is valid for a maximum of 2 (TWO) years from its issue date.
It is personal, non-transferable, indivisible, and can be used only once, within its validity.

Article 6. Trip Modification

6.1. Modification or Cancellation by the Client
a. Conditions and Procedures for Cancellation
The services offered are not subject to a right of withdrawal (Article L. 221-28 of the Consumer Code).
The Client may cancel at any time, subject to cancellation fees.
Cancellation must be sent in a way that allows for proof of receipt. The date of receipt determines the applicable fees.
Failure to pay, or any request to modify services, names, or personal information within 30 (THIRTY) days of departure will be considered a cancellation, with fees due.
Failure to show up at the designated location and time, or inability to attend, results in full cancellation charges.
No refund is given for partial use or early interruption of services.
b. Cancellation Fees
Any cancellation, even partial, by the Client incurs:
• More than 30 days before departure: 10% of total price,
• 30 to 15 days: 25%,
• 14 to 8 days: 50%,
• 7 to 3 days: 75%,
• Less than 3 days and after departure: 100%.

6.2. Modification or Cancellation by Le Vélo voyageur
a. Modification of a Key Element
If Le Vélo voyageur must change a major element, the Client will be informed as soon as possible on a durable medium.
An equivalent or higher-quality replacement will be offered at no extra cost, unless impossible or disproportionately expensive.
If the replacement is of lower quality, an appropriate price reduction will be applied.
The Client has 7 (SEVEN) days to accept the change or cancel. Without response, they are deemed to have accepted.
In case of cancellation, all payments will be refunded within 14 (FOURTEEN) days.
b. Cancellation by Le Vélo voyageur
If Le Vélo Voyageur cancels the trip, the Client is fully refunded within 14 days of notification.
Le Vélo Voyageur may cancel without notice if the Client has not paid in full 30 (THIRTY) days before departure.
If the minimum number of participants is not met, the trip may be canceled. Clients are notified at least:
• 20 days before for trips longer than 6 days,
• 7 days before for 2–6 days,
• 48 hours before for trips under 2 days.

Le Vélo voyageur may still propose continuing the trip with a surcharge. Clients have 7 (SEVEN) days to decide.
In case of force majeure or exceptional circumstances, the trip may be canceled with full refund but no compensation.

Article 7. Transfer of the Contract

The Client may transfer their contract to a third party who meets the same conditions to participate in the trip. Le Vélo voyageur must be informed of this transfer by any means that provides proof of receipt, at the latest 7 (SEVEN) days before departure, and before the contract has taken effect. Le Vélo voyageur cannot oppose the transfer if the new participant meets the required conditions.
The Client and the transferee are jointly responsible for paying the remaining balance and any potential fees or costs related to the transfer.
The Client may not transfer their insurance or assistance contracts.
A new contract in the transferee’s name will be drawn up.

Article 8. Non-Compliance

The Client must report any non-compliance observed on-site as soon as possible. Any report can be made:

Expenses unilaterally incurred by the Client without prior agreement from the Company will not be reimbursed or compensated.
Failure to report a non-compliance issue cannot be grounds for refund or damages.

Article 9. Assistance

Le Vélo voyageur provides a phone assistance service available daily from 8:00 a.m. to 8:00 p.m. at the following number: +33 (0)6 60 78 90 45
This assistance covers questions or requests related to the services provided, excluding punctures.

Article 10. Insurance

10.1. Offered Insurance
Le Vélo voyageur offers travel and bike equipment insurance in partnership with AXA Assistance and Laka. Before subscribing, Clients are advised to check if such coverage is already included in another policy.
Full terms and conditions of the insurance can be found in the Insurance section of the website or upon request.
Clients are strongly advised to read them carefully.
10.2. Activation and Exclusions
It is the Client’s responsibility to contact AXA Assistance (or another provider) directly to activate coverage before or during the trip.
The following items are not reimbursable by Le Vélo voyageur or the insurer:
• Insurance premium,
• Visa fees,
• Registration fees,
• Cancellation fees for cancellations made more than 60 days before departure.
10.3. Available Coverage
Trip cancellation insurance covers 24 valid reasons, including illness, accident, job loss, exam rescheduling, or changes to vacation leave by the employer.
Travel security insurance (for trips under 90 days) includes trip assistance and cancellation coverage, protecting the Client and their family throughout the trip.
Bike insurance covers rented equipment (bikes and child accessories). The use of the provided lock is mandatory to activate this coverage.
In case of damage to rental equipment, the Client must immediately inform Le Vélo Voyageur.

Article 11. Liability

11.1. General Provisions
Le Vélo voyageur uses all reasonable means to deliver the services described in the contract.
Le Vélo voyageur cannot be held responsible for outcomes resulting from force majeure, third-party actions outside the contract, improper execution attributable to the Client, or other exceptional and unavoidable circumstances.
If non-compliance causes harm, compensation may be limited (except in the case of bodily injury or gross negligence) to no less than three times the total trip price.
Le Vélo voyageur is not liable for theft, loss, forgotten items, or damage to the Client’s belongings. Clients must take all necessary precautions.
Le Vélo voyageur is not liable for errors in bookings made by the Client or for any services booked independently, outside the official trip description.
It is also not responsible for delays or changes in train schedules that may impact the Client before, during, or after the trip.

11.2. Specific Liability – Bike Rentals
The Client is fully responsible for rented bikes and equipment until the end of the trip. They must return equipment in its original condition and cover repair costs in case of damage.
They must prove if damages are not their fault.
In case of loss or theft, the Client is responsible for all replacement costs based on the repair/replacement invoice.
Le Vélo voyageur is not responsible for punctures or repairs.
However, their rental partners must provide a repair kit to allow the Client to fix the issue themselves.
The Client acknowledges having received all safety and usage instructions and agrees to follow them and local traffic laws. Le Vélo voyageur is not responsible for any consequences of rule violations.
Clients must ensure they are physically fit for the chosen itinerary.
Le Vélo voyageur is not liable for physical or medical issues encountered during the trip.
In the event of risk, routes may be changed, or participation may be refused if the Client is deemed unfit.
Le Vélo voyageur is never responsible for cancellations due to weather, force majeure, or the Client’s non-compliance with safety instructions.
Force majeure refers to any external, unforeseeable, and irresistible event beyond the Parties’ control, as defined in Article 1218 of the French Civil Code and by case law. This includes (but is not limited to) natural disasters, wars, terrorism, epidemics, government decisions, strikes, and other exceptional circumstances preventing the fulfillment of contractual obligations.

Article 12. Administrative and Health Formalities

All necessary administrative and health formalities for the trip are available on the website.
It is the Client’s responsibility to check, comply with, and cover the cost of all administrative and health requirements necessary to complete the trip. Before registering, the Client must ensure they hold a valid passport or other travel document in accordance with the entry requirements of the destination country or countries.
Some countries require a passport valid for more than six months after the return date.
Non-EU travelers must check entry requirements with the relevant embassies or consulates before registering or traveling.
Failure to comply with these formalities is entirely the traveler’s responsibility, including if they are denied departure. Le Vélo voyageur will not be held liable for the consequences of non-compliance with police, customs, or health regulations before or during the trip, particularly in the case of lost ID or travel documents.

Article 13. Intellectual Property

Le Vélo voyageur holds exclusive intellectual property rights to all content provided to the Client as part of the services, including content on the website or documentation.
This contract does not grant the Client any intellectual property rights over Le Vélo voyageur’s brand or materials.
The Client is prohibited from reproducing, using, or representing, even partially, any element protected by Le Vélo voyageur’s intellectual property rights, by any means whatsoever.

Article 14. Personal Data

Le Vélo voyageur collects and processes the Client’s personal data (such as name, address, email, and phone number) in compliance with applicable regulations.
This data is used to manage bookings and deliver services. Some data may be shared with third-party providers (e.g., hotels, transport companies), including those located outside the EU.
The Client has the right to access, correct, modify, or delete their personal data.

Article 15. Complaints

Any complaint, particularly regarding non-compliance as defined in Article 7, must be submitted with proof of receipt within one (1) month of the return date to the following address:

Le Vélo voyageur will do its best to respond promptly.

Article 16. Governing Law and Dispute Resolution

This contract is governed by French law.
In accordance with Articles L.612-1 and following of the French Consumer Code, consumers can contact a mediator within one (1) year of submitting a written complaint.
The designated consumer mediation body is:

Use of consumer mediation is not mandatory.
If no amicable solution is reached, the Parties may bring the matter before the competent courts.
Any disputes relating to the formation or performance of this contract shall fall under the exclusive jurisdiction of the Judicial Court of Montpellier.
