GENERAL TERMS AND CONDITIONS OF SERVICES

 

Le Vélo voyageur is a simplified joint-stock company (société par actions simplifiée), having its registered office at 6 Rue Fontenille, 34000 Montpellier, France, registered with the Montpellier Trade and Companies Register under number 529 884 116 (hereinafter referred to as “Le Vélo voyageur”).

Le Vélo voyageur offers cycling-based itinerant travel packages in France and across Europe.

The “Client” means any natural person subscribing to the services offered by Le Vélo voyageur.

Le Vélo voyageur and the Client shall hereinafter be referred to individually as a “Party” and collectively as the “Parties”.

Article 1 – Purpose

The purpose of these General Terms and Conditions is to define:

  • the terms and conditions for subscribing to the services offered by Le Vélo voyageur;
  • the rights and obligations of the Parties under the contract;
  • the financial and legal conditions governing the purchase and use of the services.

Article 2 – Orders

Registration for any trip offered by Le Vélo voyageur must be completed via the website www.levelovoyageur.com (the “Website”). Prior exchanges may take place by telephone or email with an advisor.

After selecting the desired travel services, the Client completes an order form via the Website, by email, or by confirming a pre-completed order form sent by an advisor.

The order shall be deemed final upon completion of the order form.

A confirmation email shall be sent to the Client.

A travel booklet shall be provided to the Client fifteen (15) days prior to the departure date.

 

Article 3 – Payment

3.1 Price

The price of the trips is detailed in the descriptions available on the Website.

Only the services expressly included in the trip description are covered by the price.

Unless otherwise specified, the base package notably excludes transportation to the departure point, ticketing fees, tourist taxes, vaccination costs, visas, meals not specified, beverages, personal expenses, optional activities, and any services not expressly mentioned.

Any unused services included in the package shall not give rise to any refund or credit.

3.2 Payment Terms

For any booking made more than thirty (30) days before departure, a deposit equal to 30% of the total price is required upon registration.

For bookings made less than thirty (30) days before departure, full payment of the trip and insurance fees shall be required.

Payment may be made by:

  • bank transfer;
  • check ;
  • holiday vouchers (chèques vacances), limited to 50% of the total order amount.

3.3 Late Payment

In the absence of payment of the outstanding balance within fifteen (15) days, Le Vélo voyageur reserves the right to suspend performance of the services, with any resulting costs borne by the Client.

Full availability of the trip cannot be guaranteed without full payment.

 

Article 4 – Price Revision

Price increases shall only be permitted where they are a direct consequence of changes in:

  • the cost of passenger transport resulting from fuel or other energy sources;
  • taxes or fees imposed by third parties not directly involved in the performance of the contract (including tourist taxes, landing or embarkation/disembarkation fees); or
  • exchange rates relevant to the contract.

Where the price increase exceeds 8% of the initial price, Le Vélo voyageur shall inform the Client on a durable medium no later than twenty (20) days prior to departure.

The Client shall have [seven (7)] days to accept the modification or terminate the contract without charge.

 

Article 5 – Gift Vouchers and Credits

5.1 Gift Vouchers

Gift vouchers may be purchased via the “Offer this trip” link available on the trip pages of the Le Vélo voyageur website.

Payable in full at the time of purchase, the gift voucher may correspond either to a pre-selected trip or to an amount freely determined by the purchaser, which may be used towards any trip offered. It does not impose any departure date at the time of purchase and does not limit the purchaser to the initially contemplated services.

The voucher takes the form of a discount code, the monetary value of which corresponds to the total amount of the purchase.

It may be used for all trips and services offered by Le Vélo voyageur, subject to availability and the prices applicable at the time of use.

The discount code is valid for one (1) year from its date of issue and has the following characteristics:

  • strictly personal;
  • non-transferable;
  • indivisible;
  • non-extendable.

The voucher specifies the following information: the name of the beneficiary, the name of the purchaser, the reference of the discount code, its monetary value and its validity date.

It is sent to the purchaser or the beneficiary by electronic means or by post.

When making a booking on the Le Vélo voyageur website, the beneficiary must enter the discount code indicated on the voucher. If the total amount of the booking exceeds the value of the voucher—due to price changes, seasonality, or the choice of trip and services—the difference shall be payable by the beneficiary. No refund, even partial, shall be granted if the value of the voucher exceeds the amount of the booking.

The discount code must be used prior to its expiry date. Once the booking request has been validated by the beneficiary, the contract acceptance conditions set out in Article 2 shall apply. Confirmation of the trip remains subject to availability.

 

5.2 Validity of Credits

Any credit issued by Le Vélo voyageur shall be valid for a maximum period of two (2) years from its date of issue.

It is personal, non-transferable, indivisible and may be used only once.

 

Article 6 – Modification of the Trip

6.1 Modification or Cancellation by the Client

a. Conditions and formalities for changes

Any request to modify or add a service included in the trip, to correct the spelling of the Client’s name or civil status, or that of one of the travellers, or to add a participant, will incur modification fees.

In the event of trip interruption or the total or partial non-use of the planned services, the Client may not claim any refund or compensation.

b. Modification fees

Any change to the booking will incur the following cancellation fees:

  • Up to 8 days before the departure date: 5% of the total price, with a minimum fee of €50;
  • From 7 to 4 days before the departure date: 15% of the total price, with a minimum fee of €100;

1. Conditions and Formalities for Cancellation

The services offered by Le Vélo voyageur are not subject to a right of withdrawal pursuant to Article L.221-28 of the French Consumer Code.

The Client may cancel the trip at any time, in which case cancellation fees shall apply.

Any cancellation request must be sent to Le Vélo voyageur by any means allowing acknowledgment of receipt. The date of receipt of such request shall be used to calculate the applicable cancellation fees.

Failure to pay the full price of the trip, as well as any request to modify a service, the spelling of the Client’s name or their civil status within thirty (30) days prior to departure, shall be deemed a cancellation and shall give rise to the applicable cancellation fees.

Similarly, if the Client fails to attend the first service at the time and place indicated in the travel booklet, or is unable to participate in the trip, no refund shall be due and cancellation fees shall remain payable to Le Vélo voyageur.

In the event of interruption of the trip or total or partial non-use of the services, no refund or compensation shall be due to the Client.

2. Cancellation Fees

Any cancellation, even partial, initiated by the Client shall give rise to the following cancellation fees:

  • More than 30 days before the departure date: 10% of the total price;
  • From 30 to 15 days before departure: 25% of the total price;
  • From 14 to 8 days before departure: 50% of the total price;
  • From 7 to 3 days before departure: 75% of the total price;
  • Less than 3 days before departure and after the departure date: 100% of the total price.

 

6.2 Modification or Cancellation by Le Vélo voyageur

1. Modification of an Essential Element of the Trip

If an external event requires Le Vélo voyageur to modify an essential element of the contract concluded with the Client, it shall inform the Client as soon as possible on a durable medium.

Le Vélo voyageur shall offer a substitute service of equivalent or higher quality at no additional cost to the Client, unless this is impossible or would entail disproportionate costs in light of the significance of the non-conformity and the value of the travel services concerned.

If the substitute service is of lower quality, an appropriate price reduction shall be granted.

The Client may accept the modification or terminate the contract.

The Client shall have a maximum period of seven (7) days from receipt of the information to notify their decision.

Failing a response within this period, the Client shall be deemed to have accepted the proposed modification.

In the event of termination, Le Vélo voyageur shall reimburse all sums paid by the Client within fourteen (14) days following termination of the contract.

2. Cancellation by Le Vélo voyageur

If Le Vélo voyageur is required to cancel the trip, the Client shall be fully reimbursed within fourteen (14) days from notification of the cancellation.

Le Vélo voyageur reserves the right to terminate the contract automatically, without prior notice or compensation, in the event of full non-payment of the price by the Client no later than thirty (30) days prior to departure.

Where the trip is subject to a minimum number of participants and such threshold is not met, or where certain participants cancel prior to departure, Le Vélo voyageur may cancel the trip.

In such case, Le Vélo voyageur shall inform the Client no later than:

  • at least 20 days before departure for trips lasting more than 6 days;
  • at least 7 days before departure for trips lasting between 2 and 6 days;
  • at least 48 hours before departure for trips lasting less than 2 days.

Le Vélo Voyageur may nevertheless propose to the remaining participants to maintain the trip, subject to payment of any additional costs resulting from the withdrawal of other participants.

Participants shall have a period of seven (7) days prior to the start of the trip to notify Le Vélo voyageur of their decision.

Where unavoidable and extraordinary circumstances prevent the performance of the trip, Le Vélo voyageur may cancel it. Where such cancellation results from insufficient participants or such circumstances, the Client shall be fully reimbursed but shall not be entitled to any additional compensation.

 

Article 7 – Assignment of the Contract

The Client may assign the contract to a third party who meets the same conditions required to undertake the trip. Le Vélo voyageur must be informed of such assignment by any means allowing acknowledgment of receipt, no later than [seven (7)] days prior to departure, and before the contract has produced any effects. Le Vélo voyageur may not refuse such assignment provided that the assignee satisfies the required conditions.

The Client and the assignee shall be jointly and severally liable for payment of the outstanding balance as well as any fees, charges or additional costs arising from the assignment.

The Client may not assign any insurance or assistance contract.

A new contract in the name of the assignee shall be entered into between the Parties.

 

Article 8 – Non-Conformity

The Client shall report any non-conformity observed on site as soon as possible.

Any such notification may be made:

No expenses incurred unilaterally by the Client, without the prior consent of the Company, shall be reimbursed or give rise to compensation.

Failure to report a non-conformity shall preclude any claim for reimbursement or damages.

 

Article 9 – Assistance

Le Vélo Voyageur provides a telephone assistance line, available daily from 8:00 a.m. to 8:00 p.m. (French time) at the following number: +33 6 60 78 90 45.

This assistance service is intended to respond to any questions or requests relating to the services provided, excluding cases of punctures.

 

Article 10 – Insurance

10.1 Insurance Offered

Le Vélo voyageur offers Clients the possibility to subscribe to travel and bicycle equipment insurance, in partnership with AXA Assistance and Laka.

Prior to subscribing, Clients are advised to verify whether such coverage is already included under any existing insurance policy.

The general and specific terms and conditions of the proposed insurance policies are available in the “Insurance” section of the Website or upon request.

Clients are strongly encouraged to read them carefully.

10.2 Activation and Exclusions

It is the Client’s responsibility to contact AXA Assistance or any other insurance provider covering their trip in order to activate the relevant coverage, whether before or during the trip.

The following items shall not be reimbursed by Le Vélo voyageur or by the insurer:

  • the insurance premium;
  • visa fees;
  • registration fees;
  • cancellation fees incurred more than sixty (60) days prior to departure.

 

10.3 Available Coverage

Cancellation insurance covers twenty-four (24) insured events, including illness, accident, loss of employment, resit examination summons, or modification or cancellation of leave by the employer.

Safety insurance, applicable to trips of less than ninety (90) days, includes travel assistance and cancellation coverage, thereby providing comprehensive protection to the Client and their family throughout the duration of the trip.

Bicycle insurance covers rented equipment (bicycles and children’s equipment) during the trip. In order to benefit from this coverage, it is mandatory to use the lock provided.

In the event of damage to rented equipment, the Client must immediately contact Le Vélo voyageur.

 

Article 11 – Liability

11.1 General Provisions

Le Vélo voyageur shall use all reasonable endeavours to ensure the proper performance of the services provided for under the contract.

  • Le Vélo voyageur shall not be held liable for any consequences resulting from force majeure, acts attributable to a third party unrelated to the services provided under the contract, improper performance of the contract attributable to the Client, or unavoidable and extraordinary circumstances.
  • Where a lack of conformity results in damage, any compensation may be limited (except in the event of personal injury or gross negligence). However, such limitation shall not be less than three times the total price of the trip.
  • Furthermore, Le Vélo Voyageur shall not be held liable in the event of theft, loss, misplacement or damage to the Client’s personal belongings during the trip. It is the Client’s responsibility to take all necessary precautions to safeguard their belongings.
  • Le Vélo Voyageur shall not be liable for any errors made by the Client when making a reservation.
  • Le Vélo voyageur shall not be liable for services purchased by the Client on site that are not included in the trip description, nor for transport arrangements to the departure point or from the arrival point of the trip, which remain the sole responsibility of the Client.

Similarly, Le Vélo voyageur disclaims all liability in the event of delays, schedule changes or route modifications by railway carriers used by the Client before, during or after the trip. In such circumstances, no compensation may be claimed for any inconvenience suffered.

 

11.2 Specific Liability Relating to Bicycle Rental

The Client shall be fully responsible for the rented bicycle and its equipment until the end of the trip. The Client undertakes to return the equipment in its original condition and to bear the cost of any repairs in the event of damage attributable to the Client. It shall be the Client’s responsibility to prove that any damage is not attributable to them.

  • The Client shall also bear all costs relating to the loss or theft of the rented equipment, based on the repair or replacement invoice.
  • Le Vélo voyageur shall not be held liable for punctures or their repair.
  • However, Le Vélo voyageur shall ensure that its rental partners provide a repair kit enabling the Client to carry out necessary repairs independently.
  • The Client acknowledges having received all necessary information regarding safety rules and instructions for the use of the equipment. The Client undertakes to comply with such instructions as well as with applicable traffic regulations and shall remain solely responsible for their compliance. Le Vélo voyageur shall not be held liable for any consequences resulting from the Client’s failure to comply with such rules.
  • The Client must ensure that they are physically fit to complete the chosen route.
  • Le Vélo voyageur shall not be held liable for any physical or medical difficulties encountered during the trip.
  • Le Vélo voyageur shall use all reasonable efforts, through its service providers, to ensure the safety of participants. Le Vélo voyageur may modify the planned itinerary in the event of a proven risk or refuse participation to a Client deemed unfit for cycling.

In all circumstances, Le Vélo voyageur shall not be held liable for any failure to perform resulting from adverse weather conditions, force majeure or the Client’s failure to comply with safety rules.

Force majeure shall mean any external, unforeseeable and irresistible event beyond the control of the Parties, as defined under Article 1218 of the French Civil Code and applicable case law. This includes, without limitation, natural disasters, armed conflicts, acts of terrorism, epidemics, decisions of public authorities, strikes, and any other exceptional circumstance rendering the performance of contractual obligations impossible.

 

Article 12 – Administrative and Health Formalities

The administrative and health formalities required for the performance of the trip are available on the Website.

It is the Client’s responsibility to obtain information regarding the administrative and health formalities required for the performance of the trip, to comply with them and, where applicable, to bear the related costs. Prior to booking, the Client must ensure that they hold a valid passport or any other valid travel document meeting the requirements for transit to or entry into the destination country or countries.

It is hereby specified that certain countries require that passports remain valid for a period exceeding six months after the date of return.

Travellers who are not nationals of a Member State of the European Union must, prior to booking and departure, obtain information on the applicable administrative and health formalities from the relevant embassies and consulates.

Failure to comply with such formalities shall be the sole responsibility of the traveller, including in the event of inability to depart on the scheduled date. Le Vélo voyageur shall not be held liable for the consequences of failure to comply with police, customs or health regulations before or during the trip, in particular in the event of loss of identity documents or transport tickets.

 

Article 13 – Intellectual Property

Le Vélo voyageur is the exclusive owner of all intellectual property rights relating to the elements provided to the Client in connection with the provision of the Services, whether available on the Website or in the documentation provided.

This Agreement does not entail any transfer of intellectual property rights from Le Vélo voyageur to the Client, in particular with respect to its trademarks.

The Client undertakes not to reproduce, use or represent, by any means whatsoever, even partially, any element in which Le Vélo voyageur holds intellectual property rights.

 

Article 14 – Use of Content and Image Rights

The Client may provide Le Vélo voyageur with photographs, videos or any other content (hereinafter the “Content”) in the context of sharing their experience.

  • By providing such Content, the Client authorises Le Vélo voyageur to use it free of charge for the purposes of its communication and commercial promotion.
  • The Client acknowledges that the Content provided may include their image or that of third parties and agrees to its use under the conditions set out in this Article.
  • The Client may at any time request the removal of all or part of the Content or object to its use by submitting a request to Le Vélo voyageur.

Le Vélo voyageur undertakes to cease any use of the relevant Content as soon as possible, subject to materials already printed and until existing stocks have been exhausted.

 

Article 15 – Personal Data

Le Vélo voyageur may collect and process the Client’s personal data (including first name, last name, postal and email address, and telephone number) and undertakes to comply with applicable regulations.

Such data collection is necessary to manage Client requests and ensure the performance of the contracts entered into. For the purposes of the trip, certain data may be transmitted to service providers (hotels, carriers, etc.), including partners located outside the European Union.

The Client has the right to access, modify, rectify and delete their personal data.

Article 16 – Complaints

Any complaint, in particular in the event of non-conformity as referred to in Article 7, must be submitted by any means allowing acknowledgment of receipt within one (1) month following the return date, to the following address: 6 Rue Fontenille, 34000 Montpellier, France.

Le Vélo voyageur shall endeavour to respond as soon as possible.

 

Article 17 – Governing Law and Disputes

This Agreement shall be governed by French law.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, you may, as a consumer, refer the matter to a mediator within one (1) year from the date of your written complaint.

The following consumer mediation body has been designated:
Association Médiation Tourisme et Voyage – CS 30958 – 75383 Paris Cedex 08, which may be contacted by completing the referral form directly on its website: https://www.mtv.travel/

The European Commission’s online dispute resolution (ODR) platform may also be used: ec.europa.eu/consumers/odr/.

Recourse to a consumer mediator is not mandatory.

In the absence of an amicable resolution through this process, the Parties remain free to refer the matter to the competent courts.

Any dispute relating to the formation or performance of this Agreement shall fall under the exclusive jurisdiction of the Judicial Court of Montpellier.
